Description

One of the IDEA’s hallmarks is its provision of multiple rights that are designed to assure meaningful parental participation. More specifically, IDEA delineates a district’s obligation to assure meaningful parental participation in virtually all matters related to the evaluation, identification and provision of a free appropriate public program (FAPE). This session will explore these rights, as well as how courts have dealt with allegations of a denial of parental participation, such as alleged “predetermination.” It will also examine the case law interpreting IDEA’s provision limiting a hearing officer’s authority to base denial of FAPE on procedural violations in relation to meaningful parental participation.
