Description

This session will address the leading approaches utilized by courts in cases alleging a denial of FAPE based upon inadequate IEP implementation. It will compare the standard articulated by the Ninth Circuit Court, which does not require proof of demonstrable educational harm, with the Fifth Circuit’s approach, which appears to excuse non-implementation if the student received educational benefit from the IEP. The presentation will also examine whether, and to what extent, these standards differ from those utilized by state complaint investigators.
